Terms of Service

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you meet this requirement.

The Service is intended for business use. You agree to use it solely for lawful business purposes and in compliance with all applicable laws and regulations.

You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately at security@masit.io if you suspect any unauthorised use of your account.

You may not share your account credentials with third parties or create accounts for the purpose of reselling access to the Service without our express written consent.

We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or pose a security risk to our platform or other users.

Masit provides a growth intelligence and marketing execution platform that includes campaign attribution, creative analytics, media planning, lifecycle automation, and access to our growth advisory team (collectively, the "Services").

The specific features available to you depend on the subscription plan you have purchased. We reserve the right to modify, update, or discontinue features at any time, provided we give reasonable notice for material changes.

For managed services (where our team executes campaigns on your behalf), additional statements of work ("SOWs") will detail scope, timelines, and deliverables. SOWs are incorporated into these Terms by reference.

Subscription fees are billed in advance on a monthly or annual basis, as selected at checkout. All fees are exclusive of applicable taxes (VAT, GST, etc.), which will be added where required by law.

Payment is processed via Stripe. By providing payment information, you authorise us to charge your payment method on a recurring basis. Failure to maintain valid payment details may result in suspension of your account.

Annual subscriptions are non-refundable except where required by applicable consumer law. Monthly subscriptions may be cancelled at any time; access continues until the end of the current billing period.

We reserve the right to change our pricing with 30 days' notice. Continued use after the price change takes effect constitutes acceptance of the new pricing.

Masit retains all intellectual property rights in the Service, including the platform software, attribution models, algorithms, design, and documentation. Nothing in these Terms transfers ownership of any intellectual property to you.

You retain ownership of all data you input into the Service ("Customer Data"). You grant Masit a non-exclusive, worldwide licence to process Customer Data solely to provide the Service and as described in our Privacy Policy.

We may use anonymised, aggregated data derived from Customer Data to improve our products, publish industry benchmarks, and train machine learning models, provided this data cannot be traced back to you or any individual.

You agree not to reverse-engineer, decompile, copy, or create derivative works from any part of the Service.

You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property rights of any third party; transmit malicious code, spam, or unsolicited communications; attempt to gain unauthorised access to our systems or those of third parties; or engage in any activity that could damage, disable, or impair the Service.

You are solely responsible for the advertising campaigns you run through the Service and must comply with the advertising policies of any connected platform (Meta, Google, TikTok, etc.).

Masit reserves the right to investigate suspected violations and to remove content or suspend access without prior notice where immediate action is required.

Each party may have access to the other's confidential information in the course of the business relationship. Each party agrees to protect the other's confidential information with at least the same degree of care it uses to protect its own confidential information (and not less than reasonable care), and not to disclose it to third parties without prior written consent.

Confidentiality obligations do not apply to information that: is or becomes publicly known through no breach of this agreement; was rightfully known before disclosure; is independently developed without use of confidential information; or is required to be disclosed by law or court order.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted or error-free, that defects will be corrected, or that results (including advertising performance metrics) will meet your expectations or objectives. Past performance is not indicative of future results.

Any guidance, recommendations, or strategies provided by our growth team are advisory in nature. We make no guarantee of specific outcomes from their implementation.

To the fullest extent permitted by applicable law, Masit's total liability to you for any claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the total fees paid by you in the 12 months preceding the claim, or (b) £1,000.

In no event will Masit be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, revenue, data, or goodwill, even if advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under applicable law.

You may terminate your account at any time from your account settings or by contacting support@masit.io. Termination takes effect at the end of the current billing period.

We may suspend or terminate your access immediately upon written notice if you breach these Terms, fail to pay fees, or if we are required to do so by law.

Upon termination, your right to access the Service ceases. We will retain your data for 90 days, during which you may export it. After 90 days, we will delete it in accordance with our Privacy Policy.

These Terms are governed by the laws of England and Wales. You and Masit agree to submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any dispute arising from these Terms or the Service.

Before initiating legal proceedings, each party agrees to attempt in good faith to resolve any dispute through direct negotiation for a period of 30 days following written notice of the dispute.

If you are a consumer in the EU, nothing in these Terms affects your rights under mandatory local consumer protection law.

We may update these Terms from time to time. For material changes, we will provide at least 30 days' notice via email or an in-product notification before the updated Terms take effect.

Continued use of the Service after the effective date of any change constitutes your acceptance of the revised Terms. If you do not agree, you may terminate your account before the effective date.
